বেসরকারি বিশ্ববিদ্যালয় থেকে ১৫ শতাংশ হারে আয়কর আদায় থেকে আপাতত বিরত থাকতে সরকারকে নির্দেশ দিয়েছেন হাইকোর্ট।
ইউনিভার্সিটি অফ এশিয়া প্যাসিফিকের পক্ষে করা এক রিট আবেদনের প্রাথমিক শুনানি নিয়ে সোমবার (২০ সেপ্টেম্বর) বিচারপতি সৈয়দ রেফাত আহমেদ এবং বিচারপতি শশাঙ্ক শেখর সরকারের সমন্বয়ে গঠিত হাইকোর্ট বেঞ্চ রুলসহ এ আদেশ দেন।
আদালতে আবেদনের পক্ষে শুনানি করেন আইনজীবী ড. চৌধুরী ইশরাক সিদ্দিক।
এর আগে গত ১৬ সেপ্টেম্বর এ রিট দায়ের করা হয়। রিটে আইন মন্ত্রণালয় সচিব, অর্থ মন্ত্রণালয় সচিব, এনবিআরের চেয়ারম্যানসহ ৫ জনকে বিবাদী করা হয়।
অর্থ আইন, ২০২১ এর তফসিল ‘খ’ এর সিরিয়াল ৭ চ্যালেঞ্জ করে হাইকোর্টে রিট দায়ের করে ইউনিভার্সিটি অফ এশিয়া প্যাসিফিক। উক্ত অর্থ আইন, ২০২১ এর তফসিল ‘খ’ এর সিরিয়াল ৭ এর মাধ্যমে বেসরকারি বিশ্ববিদ্যালয়ের উপর ১৫ শতাংশ কর আরোপ করা হয়। শুনানি শেষে রুল জারি করেন এবং আরোপিত ১৫ শতাংশ কর আদায় করা হতে সরকারকে বিরত থাকার নির্দেশ দেন আদালত। এ আদেশের ফলে সরকার বেসরকারি বিশ্ববিদ্যালয়ের নিকট কর আদায়ের দাবি করতে পারবে না।
প্রসঙ্গত, গত তত্ত্বাবধায়ক সরকার বেসরকারি বিশ্ববিদ্যালয়ের ওপর কর আরোপ করলে বেসরকারি বিশ্ববিদ্যালয়গুলোর রিট আবেদনের প্রেক্ষিতে উচ্চ আদালত ২০১৬ সালরে ৫ সেপ্টেম্বর ২০১৬ বেসরকারি বিশ্ববিদ্যালয়ের উপর কর ধার্য করাকে অবৈধ ঘোষণা করেন। এর বিরুদ্ধে সরকারের আপিলের প্রেক্ষিতে আপিল বিভাগ চলতি বছরের ৯ ফেব্রুয়ারি এক আদেশের মাধ্যমে সরকারের আপিল নিষ্পত্তি না হওয়া পর্যন্ত বেসরকারি বিশ্ববিদ্যালয়ের ওপর কর আরোপ না করার জন্য আদেশ দিয়েছিলেন।
